I. Who is responsible for processing your data?

This privacy policy (hereinafter, the “Privacy Policy”) applies to all personal data provided by the user to PROFESSIONAL SPAIN CONSULTING SL, with registered office at Avda. Ricardo Soriano, 72 Edif. Golden Portal B – 1st Floor, 29601, Marbella, Málaga, hereinafter PROSPAINCONSULTING.
For the purposes of this Privacy Policy, “User” shall mean any natural person interested in the products and services offered by PROSPAINCONSULTING through its websites. PROSPAINCONSULTING, as the data controller, will request the User's express consent to this Privacy Policy before collecting any personal data, where such consent is required, and for any other aspect requiring prior authorization.

A. To manage contracts and requests made by the User via PROSPAINCONSULTING websites and associated entities. B. To inform the User by any means, including sending commercial communications to the email address provided, about PROSPAINCONSULTING products and services similar to those previously purchased. C. To carry out promotional activities, including the sending of commercial communications to the email address provided by the User, about products or services from third-party companies in the education sector.

III. What is the legal basis for processing your personal data?
  • The legal basis for processing data for purposes (A) and (B) is the performance of the contract for the provision of services and/or purchase of the relevant products.
  • The legal basis for processing data for purpose (C) is the consent that may have been requested from the User. The withdrawal of this consent will not affect the performance of the service contract. The User’s personal data will not be processed for these purposes unless PROSPAINCONSULTING has requested and obtained their consent.
At the time of registration, PROSPAINCONSULTING will collect and process the essential personal data needed to register and access the User’s personal account. If the User decides to purchase one of PROSPAINCONSULTING’s products or services, the company will collect and process the necessary data for managing the contracting process (including name, surname, ID, passport or other ID document, address, etc.).
The User acknowledges and accepts that failure to complete certain personal data may prevent PROSPAINCONSULTING from providing all services linked to such data. Under no circumstances will this data be transferred or used for purposes other than those expressly indicated here.

PROSPAINCONSULTING will retain client and user data for the duration of the contractual relationship and, subsequently, for promotional activities for a period of ten years (unless the processing is based on consent and the User revokes it, in which case the data will be retained until such revocation is received). Thus, data will not be retained longer than necessary for the purposes described above, without prejudice to necessary retention for the establishment, exercise, or defense of legal claims, or when permitted by applicable legislation.

PROSPAINCONSULTING may disclose or share personal data to comply with its obligations to Public Authorities when required by current legislation, and where appropriate, to other bodies such as law enforcement and the judiciary.
PROSPAINCONSULTING may also share data with its affiliated companies in the legal sector, including law firms, other professionals such as translators or interpreters, notaries, and public registries.

PROSPAINCONSULTING informs the User of their right to exercise the rights of access, rectification, opposition, deletion, portability, and restriction of processing, as well as to object to the automated processing of personal data.
These rights may be exercised free of charge by sending a written request to lawyer@prospainconsulting.com. The request must include the subject line "Data Protection" and provide the following details: full name, address for notifications, a photocopy of the National Identity Document or ID card, and a clear request.
Additionally, Users have the right to withdraw their consent at any time, as described above, without affecting the legality of the processing carried out prior to withdrawal. PROSPAINCONSULTING may continue to process the User's data to the extent permitted by applicable law, especially for compelling reasons.
Likewise, when the processing of the User's data for purpose (C) is based on legitimate interest, the User may object to it.
PROSPAINCONSULTING reminds Users of their right to lodge a complaint with the relevant supervisory authority.
